I represent a wide array of clients in a variety of disputes, ranging from failed real estate deals to employment disputes. Here is a sampling of some of my successful client resolutions from 2019 and 2020.
Dismissal and full recovery of attorney fees for clients sued over real estate deal
In late 2018, my clients were sued over a failed residential real estate contract. The property was eventually sold to another buyer, but the sellers sued my clients because they did not perform under a contract to purchase the property at a higher price. I obtained a dismissal of the lawsuit with prejudice and my clients recovered the full amount they paid in attorney’s fees.
Blocked client’s competitor from obtaining customer records
In early 2019, my client’s business competitor sued my client and aggressively used subpoenas in an attempt to access valuable information about my client’s customers. Using my knowledge of Texas law, I quickly moved to block the competitor from obtaining the records and put the competitor on the defensive by moving to dismiss the entire case. The case remains pending, but to this day the competitor has still not obtained my client’s customer records.
Complete win defending client against a former employer
In mid-2019, I teamed up with Jack Nichols of the Law Office of Jack Quentin Nichols to defend a highly successful sales professional when his former employer sued him, his subsequent employer, and others based upon unsubstantiated allegations of breaching an employment agreement, misappropriating trade secrets, and tortiously interfering with other employees’ contracts. We successfully blocked the former employer’s attempts to conduct unnecessary discovery and run up litigation expenses, then persuaded the court to dismiss the case on all counts and award most of the attorney fees our client incurred in his own defense. Although the former employer urged the court to reconsider its ruling based upon recent developments in the law, we fought back and the court’s original decision became a final judgment. The case is currently on appeal.
Big verdict for executive against former employer
In mid-October 2019, I supported another colleague, Kerry O’Brien of the O’Brien Law Firm, as second chair in a three-day federal jury trial in Waco, Texas. We represented a business development executive in a breach of contract claim and won a $504,000 jury verdict against our client’s former employer for unpaid commissions. Prior to the final judgment being entered by the Court, the parties settled the dispute on confidential terms.
Resolved dispute over disclosure in real estate transaction
In April 2020, I helped a residential real estate investor resolve a dispute with a seller and her realtor. The dispute concerned key information about the property’s potential use that was not accurately communicated before the sale and not known to the investor until well after closing on the property. Using Texas consumer protection and anti-fraud laws as points of leverage, I negotiated a resolution for my client on confidential terms.
